Ouch! so a Markman loss will mean a lengthy delay in patent monetization efforts provided an appeal goes well. I thought that both EDIG/DM and the defendants agreed that if the first 2 claims were interpreted our way the rest of the claims would be defined by the court but if the first 2 claims went the defendents way it was "dispositive" or "game over" for us and the rest of the claims would NOT be interpreted. Please correct me if I am wrong. Also, although it has been 140+ days from the Markman the judge probably has not been spending much of that time on this case but I am hoping that if the first 2 claims did not go our way the judge would have ruled by now. Finally, WI-LANs Stockhouse board is totally buggy and slow kind of like the old Agoracom. They should migrate over to boards that function better.
