We will all defer to our resident Legal Eagle in this or any other case. However, this may be more of a semantics issue than factual. I am a little confused by DRCAL's statement because it seems to say two different things. It may simply reflect his understanding of the proceedings but because of how the statement is worded it is questionable to me whether he actually believes their is a Judgement entered in plaintiffs favor. If it were me, I might question the choice of words but not the integrity of the speaker in this or any other case. And the only reason this topic has merit as it relates to DGRI is to make the point that DRCAL believes that in comparison to the government, DGRI's integrity is far greater. This all the time I can afford to spend on this.

The 9th Circuit Court of Appeals dismissed the case and the dismissal is being appealed. The shareholders had won several rounds. CMKX was turned into a sting operation by the SEC and FBI. The sting was aimed at the MMs and brokers and promoters. That's real because I was once one of the largest shareholders. A friend of nine was told by the FBI to tell me to sell out because it was a sting. There's lots of crazies and disinformation out about the case.
Basically, the government does not have sovereign immunity in cases of its wrongdoing because the shareholders have never been made whole. The case was against the individual SEC Commissioners.
Such cases are not finally settled in court but in Congress. Usually the courts have to be exhausted. I was one of the lobbyists and the final one who helped the Japanese in-turned during WW11 get their settlement from Congress. Ted Hattori was a friend of mine whose family had lost everything so I decided to help him and all of the others to end their plight.
