Aside from all the fancy words - sometimes just plain logic dictates whats going on....
And what you suggested in a form of question would need to be resolved after GSA - That is where this is at right now! and maybe that is what you were getting at ? and I misunderstood you?
If everything is spun off into a new company then who would you go after is the more appropriate question...
would that be the New Company, JPM, or FDIC??
Go after the baby - easier kill but then again they may be bought for the NOL's? then your back into behemoth territory....(especially by the time you round up the troops and allocate the funding for attorneys)
After 24 months in Bankruptcy it is safe to assume that THJMW wouldn't let another party at the table - for an innumerable amount of reasons.... but here is a few in short and my strongest opinion.....(not that it matters)
1. U.S. Trustee can appoint an EC - they did - no matter how one dices it, they should represent DIMEQ (should) because it was traded as an equity....
2. Judge can appoint an EC as well, (and in this case received her blessing) if she felt that DIMEQ would be slighted in this case something would of been brought to the fore....(and possible has been mentioned by her in the chambers?)
3. DIMEQ has been long time in litigation even prior to the bankruptcy - pull up the charts lol this never trade above 40 cents? Why? And the banking industry was a whole different game back then.... all kinds of money (real or imagined) available to resolve the problem - ....
....and now how much should these walk away with ?? what is fairness in the Judge's eyes? or EC eye's? or worst yet FDIC/JPM eye's???
That is why I never bought these - never made sense to me....
Your a very intelligent person RM - you are probably in the top 10 I have ever ran across (book smart) probably top 5 for that matter, however we need to look outside of the issue (DIMEQ not me) and see what the general case (WAMU) dictates and the holders pre-seizure are legitimately worthy of.... hope you don't chafe just being straight....
