Monk and a group of his associates attempted to execute an organized scheme to force a short squeeze on CDIV, and openly attempted to manipulate the price and volume of CDIV.
The SEC views both of these things as being illegal.
It wouldn't matter if this had been done by an investment group, individual, or some other entity.
