Neil has a $70,000 judgment. I wouldn't call that a futile attempt. (It would only be futile if GOSY and Spencer filed for bankruptcy and the debt was discharged). Spencer legally owes the money, just like taxes, his mortgage and office rent. The bigger question is how much Spencer will spend on legal fees? And by the way, under SEC regs, any judgment against an insolvent company is material.
