I don't think I said anything about who filed the leave. There haven't been any documents to reflect what exactly they are doing. The only filing was with the Daic parties when they sent in the Notice of Oral Hearing regarding striking Markle as an expert witness. The subsequent setting regarding the Leave had no follow up documents yet, so I don't know who filed it. Maybe it's related to the one concerning striking Markle, I just don't know yet because there haven't been any other documents filed.
