When it comes to collusion, it's kinda like that rule in poker when someone is all in on the flop. The other two players in the hand cannot say, "Let's knock all the way through". The game is everyone for himself. Such collusion is prohibited. Do they almost always knock all the way through, yeah they do. They just cannot propose to collude and then carry out that prohibited action of collusion.

If you can prove the shorts worked together to conspire, then by all means - prove it. Because yes, that would be illegal. Unfortunately, proving it is another matter. Now then, by posting on a public message board the intentions to pool your shares, sign letters, etc...the proof is all their pertaining to this situation.
