As far as the accusation of fraud is concerned there is a legal definition of fraud and it would appear that there isnt definitive prooof there has been a fraud according to a legal definition.

Total nonsense. There is more than adequate proof of fraud. BTDG made the fraudulent claims concerning the fake gold mine and presented a bogus Ni 43-101 to investors while attempting to raise 2 million dollars. That would fly as fraud in any competent court.
