You seem to be confused, thinking that NIJ certification is required for body armor of Bourque Industries to be manufactured and used in the "real world".

As for obtaining government contracts for use in the military, that seems to be required, but not for state, city, and town police forces, and perhaps the police and military of friendly countries.

As for the NIJ to do "the right thing" for the US military, nope they will not since the NIJ is a federal entity and influenced "back-door" style by the other federal entity of the military which is influenced directly by the elected federal officials that are accountable to the lobbyist of the military complex industries that backroll their election bids.
