Obstruction of justice may be the only charge that seems to stick with those that find themselves in this predicament when the DOJ doesn't appear to be able to present their evidence. I suspect a fine and 1000 hours of washing Judge Dora's car with their famous wash/wax sponge may be appropriate, but without said evidence, who really knows?

The Judge obviously differs from your stated opinion that only transcripts are necessary to carry this further. The judge is demanding that the SEC provide the defense:

1) The production that contains the corresponding exhibits to the transcripts of the SEC depositions. SEC claims "technical deliveries" as their reason for not providing this.

2) Financial records database. SEC claims they are still copying those records.

3) Imaged hard drives from all computers confiscated. Although the SEC claims all hard drives were imaged on May 5th 2010, the SEC claims that two of the computers were removed from the search sites and imaged elsewhere. Those two computers were subsequently returned. (not sure if they even know where any of this stuff is any longer)

I would suspect that Judge Dora will grow impatient with the DOJ's stall tactics, and perhaps all of the charges will be thrown out IMO. I will wait patiently for April 8th...
