Everything in a BK case must go through the courts to be finalized, and Kaufmans choice for final payment( since it is in the DS/POR, whether it be stock or 115% cash) must be approved by the court.He cannot just decide and then get payment.There has to be a formal hearing after he makes a choice.

That is what I believe is meant by ' the Court has not ruled'.
Most likely a rubber stamp formality but it must be done.

Not that the court gets to decide which option.

But the text of the application clearly states Kaufman has not decided on which payment to take yet and the Judge has not approved the 100% of all services listed in this application.
