That is months old news but looking at it for the first time many would come to the conclusion you did. The status will remain that way until the permits have been approved. There is a final draft air permit, copy of it has been filed, that explains how JBI is to operate with the single processor. JBI applied for a newer air permit January 15, 2011 that allows operation of more than one processor at the Niagara Falls factory. I'm too lazy right now to look up the dates for submission of the solid waste permit. Once the DEC accepts approves the new permits it takes about 10 days for information to be updated on their website. JBI is in full operation, best way to prove it for yourself is to call the DEC and confirm for yourself.
