Absolutely!

Sometimes nothing is a scam but they evolve into a scam so they continue to TRY to build a business legitimately and may have products, sales, and work 80 hours a week but just aren't turning enough of a profit for them (or not at all) so the scam could be false PRs, made-up profits, secretly selling of shares the whole time.
