I worked for one of the largest companys in AMERICA, I did a lot of million dollar contracts, ND was a standard part of ALL deals.. Period!! Also this company had to push things through PUC's and trust me you don't want Newspaper articles mocking or chiding them while they are deliberating!!! You don't push them to the wall on these types of matters...

And, can't tell you how competitors LOVE to get tip offs on pricing, costs, timing, or anything else they can use to their advantage...

so.. MBB is doing the right thing IMO... again.. why I am here..!!
