I think should know that Barnett has testified that none of the postings in his name on message boards including on the private yahoo board, were made by him but rather by a hacker using the company computer.

Hard drive crashes and hackers have been given as excuses not to have available requested information in past court cases. The point was that this document should have also been lost in the same calamities that prevent documents from being produced that would aid in tracking down $3M in funds raised by selling shares among other things.
