Yes, SEC is bit more relaxed in clamping down on naked shorting imo.
In this case if the the company does not increase the O/S for atleast another month, ST/NITE will have to pay for their naked shorting sins..fingers crossed.

Class action lawsuit: Excellent, would hit brokers' reputation.
Scottrade spends a ton on image advertising to build up their reputation -

A class-action lawsuit might lead mgmt. to slow down their shorting operation.

I'm all for filing a class action lawsuit for the naked shorting, . . . As a group we will get our due be it via SEC requirements or the legal system.

In a class action the class member gets a few free trades or a few dollars and the attorneys get most of any $$$.
