Johnik-- you may have the last say WRT the elements of the lawsuit that suggest a balance in favor of one side -vs- the other. Although it would make for interesting discussion-- as it relates to the company JBI -- it does not appear to me that it makes a significant impact. I am in agreement with others posting as such.

As a side note-- I have experience with civil litigation in Florida. I do not see anything from either side that strikes me as unusual at this point in the (duly noted infancy stage of the) process.

With all due respect jimmenknee, I at least have seen far more posts drawing unfavorable inferences from the so-called "bombshell" emails from the CEO than I have any criticism about possible misgivings of Kaplanis. Haven't you drawn some of those negative inferences yourself? (hint: "stock promotion" comments)



Absolutely-- directly relating to the company and has had an impact as well as suggesting the potential for continuing/future impact. That is the purpose to discussing JBI on a "neutral" stock message board.

Traders have a desire to gain an "edge" in understanding elements that favor price movement in either direction. For a "struggling" development stage company, it is a critical component both when deciding to enter and timing the entry. I argued the "promotion" theory early on (as did others). The e-mails represent an opportunity to validate what had transpired and what will likely continue. If one understands the "promotion" dynamic, one can temper the "data comprehension" (i.e promotion -vs- bear raid).

A true trader IMO works under a "neutral lean" environment. If it were clear that the beginnings of JBI were in part an effort to move the price before establishing a base to support it, then active trading would have signaled all to risk manage as the price approached "critical mass." These are the discussions that really count, the rest is "white noise."

The label promotion works just as the label dilution-- nothing in the word; everything in its use. Promotions and dilution are a necessary part of a public company's evolution-- it is not all bad.

The elephants are in the room-- silly to both pretend they are not and even sillier to not try to understand the space they occupy. If they get addressed by some tangential means-- at least they get addressed.

Do some "push" too hard and perhaps "cut" too sharply? I believe so; but I do not believe I do that in general.
