I'm not sure what you mean by apply for a stay. The 90 day stay for Tmob/Calypso will be up in Dec, so unless they get a settlement agreement or request another stay, the case is scheduled to go back to processing in Fed Court. I don't believe the Daic parties are going to go through with the trial because they have too much to lose. They previously attempted to get the patent, which is what the state case is all about. They will soon realize that isn't a possibility and go for a settlement, imo.
