magicatlast,

All good points but it does NOT explain why they are still required to list them on their filings. If they dropped these items from their list of legal issues in their official SEC reports, I would be happy to follow that line of thinking. But, so long as they still have to list them each and every quarter I will stick to my thinking that these issues are not completely gone.

Magic, Strauss and others.
If I could chime in here, I'd point out that other posters with legal backgrounds have suggested that the DOJ rarely officially "closes" any investigation. Those posters have said that investigations simply fade away into history.

I'm of the opinion that the investigation is entirely over and we'll never officially hear about it again. Further, Majic is right about the statute of limitation having expired and the important fact that no charges were ever filed! IMO it was a politicly motivated witch hunt and ERHC was only guilty of association and appearance. There was never any proof of wrong doing. IMO the best money we've spent so far was on the top notch (and expensive) legal team that represented us.

Ok...back to lurking. Good discussion this morning by the way.
I'm hoping for some positive news on drilling and about consolidation of junior partners in the JDZ blocks 1-4 by the end of the second phase I extention this March.

Best to the long term investors.

"should be sufficient clearance for anyone"

Here is cut and paste from the MOST RECENT company filing

http://www.sec.gov/Archives/edgar/data/799235/000114036110040478/form424b5.htm

page 8

"..We are under investigation by the SEC, the DOJ and a U.S. Senate Subcommittee, and any adverse outcome could have a material adverse effect on our business, prospects, operations, financial condition and cash flow..."

Perhaps a wise shareholder should advise the Peter and the underwriters (who collected big bucks) that the investigation is done.
