First, I really question that most biologics are a product of nature and not an invention.

LMWHs do not exist in nature.
MABS do not exist in nature.

These are clearly inventions, and deserve patents.

The discovery of a gene obviously does not deserve patent protection.

True inventions based on the discovery of such gene deserve protection., but that should not be broad enough to allow claims on any use of the discovery of the gene.

I think this quote from the article makes the distinction.

However, the government suggested such a change would have limited impact on the biotechnology industry because man-made manipulations of DNA, like methods to create genetically modified crops or gene therapies, could still be patented.
