but the fact that they announced they would deploy the large processor in July of 2009 yet they hadn't even applied for a permit is a good indication that they didn't know they needed one.

Do you have a link that shows the company ever said that they would run a full commercial operational 20 P2O processor in July 2009?

Seems like a ridiculously false allegation unless you can prove otherwise.
