If you take volume availability to mean a frequency advantage, then when would you expect AMD to be at in volume with 90nm? After all, he vast majority of 90nm A64s are still sub-2.2GHz. Perhaps AMD rightly considers themselves "9-12" months behind Intel in 90nm availability.
