Here is the docket for the main Copaxone patent case. Before anyone gets excited about the dismissal of the foreign defendants at the end, so far as I can tell that seems to me to be of little substance, it dismisses just the two foreign entities Novartis AG and Sandoz International GmbH, the claims against the US entities Sandoz Inc and Momenta remain and the patent dispute is ongoing. However, it is possible that some of this procedural frou frou has occupied the court and slowed things down.

Copaxone Patents in Litigation

Teva has nine US Copaxone patents being litigated with NVS/MNTA as indicated below. All nine patents are related and have the same inventors. For reasons that are unclear, only seven of these nine patents are listed in the FDA’s Orange Book; these seven have an Orange-Book expiration date of 5/24/14.

(Teva attempted to have three additional Copaxone patents pertaining to molecular-weight markers [Nos. 6514938, 7074580, and 7163802] included in the litigation, but this request was denied by the Court.)

Update on Copaxone patent case (from MNTA’s 3Q10 CC):

• As reported in the public court pleadings, NVS/MNTA intend to pursue four arguments: i) indefiniteness of Teva’s patents; ii) invalidity of Teva’s patents due to obviousness and/or double patenting; ii) non-infringement by NVS/MNTA’s product; and iv) inequitable conduct.

• According to Craig Wheeler, the Court’s denial of NVS/MNTA’s motion for a summary judgment on patent indefiniteness does not impair NVS/MNTA’s ability to argue this point at trial.

• The Court consolidated Teva’s suit against NVS/MNTA and Teva’s suit against Mylan, which will delay the start of the trial until 1H11.
