The escrow is with the court, according to Brian's message on the Pickens site... Its up to the court. They could order a different agreement for the loan so there is "comfortableness" with it. It will be up to the court to decide if the escrow goes with the loan under different terms or if the agreement is null/void. Either way, Brian said we have enough money to proceed with the warehouse... So SYNJ must have more cash somewhere...
"We discovered irregularities with a lending group and had a judge freeze 600K of closing monies being held in escrow for a $5 million dollar credit arrangement. Apparently, after taking a closer look at the details the judge became uncomfortable as well. Any way and to our relief, he ordered the escrow agent to turn over our money to the court for safe keeping."
