It's obvious the judge is more worried about expediency than fairness. Hence, I think we'll be seeing litigation from the EC if they are not allowed to present a competing plan. What do they have to lose?

Yes, he said the EC met 1 of the 9 criteria for termination. Not sure which one tho. And clearly, Gerber just wants this case to move forward and believes any fragile agreement between the Debtor and basically all parties other than the EC will fall apart in the face of an alternative plan.
