Having worked in this area with the CCPA and Fed. Cir. for~46 years as employee and advocate, the so-called new technologies, like (1) genetically engineered microbes, animal and plant forms, (2)methoda of doing business, (3) artificially created elements, (4)
newly discovered, isolated and purified compositions or genes that are developed from so-called products of nature, etc., have always presented interesting cases and issues for the lower courts "to make some sense of this." One cannot decide all cases in one fell swoop, whatever that means.
