Los: Your proposal also doesn't make sense. Why would Neustar bankroll NeoMedia? What would be Nuestar's motivation to take this extraordinary step? What would be their collateral for the transaction?
There are not a lot of options given the limitations of the agreement. One is certainly the sale and license back of the IP. Given the timeframe, this is a reasonable period to complete the transaction. Certainly, YA would have to release those assets and the delay may be related to a final ruling on the EU reexam - a gamble at best.
