It's not too late to file a CAL. We believed Swift when he said he was going to restructure the company's debt and emerge from bankruptcy. We gave him a chance only to learn that he absconded with the company's IP and started his own company producing a copy of the company's drug without informing shareholders. He sold 5-HMF and pocketed the proceeds without telling shareholders about how the funds were spent. We also know that $7 million of private equity funds was received by Dr. Pandey and shareholders were not formally informed about how these funds were spent.

We are waiting for the outcome of the bk proceedings. If the verdict is not in our interest, we'll start a CAL.
