Patents: They have applied for several patents, and have published 3 applications. The pending patents have the same protection as a patent, but of course, the final protection only follows the granting and issuing of the patent.
That said, when TheraCour/Allexcel filed with WIPO, that review resulted in an opinion of which claims in the filing would have protection. There were 6 claims, the ones Diwan and attormneys were looking for, that were deemed non-derivative and therefore merit protection as inventions.
