We need to brain storm in-depth to fully make sure that there is NO scenario in which they can wipe us out and still preserve NOLs. From what I have read so far, I am pretty sure they can't but we should all do more DD.
This would be a non-issue if Mr. Big himself is already a major shareholder. Again, if this is the case I am sure that each Cohen family member and their associates is holding 5% rather than one person holding 50%+ because if one person is holding major float then they have already lost NOL's as they would have accumulated these shares during last year. They know all this better than us :)
