#5484 RE: PanicButton #5483

nothing surprises me ~

and it's about time the sec commissioners
are truly independent and not tied to any
political party ~ the irony is for those
who watched the *commentary* on the rule
201 (alternative uptick) done a few months
back ~ it was split right down party lines

sort of ~

with ms. schapiro giving the final vote ~
that i still feel was *grudgingly* given .. :)

of course after commentary for a year and another
8 months till implemented ~ some could say change
takes time .. and not much else has *changed*

having spent the days b4 that *vote* .. calling
and interacting with their staff .. i kept asking
a few questions of all 5 ~ and not surprisingly

NOT ONE COULD ANSWER .. or had the guts to answer

my focus is always on the otc/otc bb .. particularly
since IPO funding has essentially dried up in the last
decade

i asked how is it one MM can have a MONOPOLY on
the OTC since 2007 .. without any radars pinging

how is it the sheer no. of stocks that that MM is
the PRIMARY MM on can consistently have an unhealthy pps
without any radars going off *anywhere*

why is any legit co. .. whose pps falls below X ..
pick your pps poison .. .10 cents .. or .05 cent or .01 cent
ALLOWED TO BE SHORTED? .. how does any co. survive the attn
of short volume .. that can avg over 60% on any given day?

but my last question to the commissioners' staff ~ was to me
the most important .. how can any legit co. that comes public
with plans to expand and grow .. be immediately preyed upon
by those who SHORT & DISTORT daily .. and be expected to survive?

for any length of time?

the silence was deafening ~

when one interacts with those who brought *hugely* successful
ipo's public .. just over a decade ago .. and the commentary
is ~ those same co.s couldn't come public today ~ due to sarbox

one knows there is a problem .. sarbox just the latest loophole
exploited ... by those who never miss one trick

this is a critical time for financial reform ~

small businesses have been the lifeblood of this country
but if a legit business becomes an immediate victim upon
going public .. and the data shows it .. why hasn't there
been change ~ 8 years has cost this country more than i
suspect most will ever realize or fully understand ~
