ease - Great post. I wonder how Higgins/Fish/Patriot will be able to show what was said in that phone call between Fish and Moore. I note that Moore refused to supply Higgins with any inventorship information regarding 336 when he was asked to do so as Higgins client... while Fish did so readily. This will not look good in the eyes of a judge IMO.

ease, it will be interesting to see how the judge rules on these subjects. Knowing what his slant has been in the past is a better litmus test.

ease2002 - With regards to #4 in your post... Do you know for a fact that this motion has already been denied by Judge Vogel? Could you please provide a link or some other verification?
