dnoto, following this line of thinking, as a perfect example of what happens when Lehman claims to be poor, New York state and the city are trying to get 44% of roughly 1.5 - 2 billion combined. They clearly said that they want to be in front of everyone else. If New York knew there was A>L, then do you think that they'd settle for 44%. No way! 100% baby! But, if they settle now, then they can't reverse it later. One less claim. So, LBHI settles as much as it can physically, then drops the bomb, that "Oh, yeah, we got A>L".
I wish that there was a way to know this and not have to guess.
