As I'm sure you are aware, Monty has made several trips to Nigeria and has spent many months there...Negotiations as you say have been long underway...
I would consider this document Monty's "POR" on the Nigerian front:
The banks hold the keys as XN is in receivership-and hopefully a decision will be forthcoming as to getting the doors reopened and the "drug" produced...this decision is key to our BK court POR IMO...
while the US BK judge can certainly approve any POR (or none), it is usually the POR that is voted on and passed by the creditors...
people complain about the US court delays-but it hasn't been a bad thing for us as the XN situation must be resolved before we can provide that vehicle to the creditors to get them paid and get our version of the POR adopted...All my opinion
