#34683 RE: drkazmd65 #34675

The judge will rule on the T-Mobile request for the case to be dismissed some time after March 12, when T-Mobile is due to file their response to the CLYW reply to the request for dismissal.

Things are still basically as they were, only now with T-Mobile maybe looking a little bit disoriented and confused, uncertain, and otherwise, that not being a bad thing, things still seem to be going pretty well.

None of the most recent activity seems it alters their chances much, in any way that matters. The T-Mobile request for a delay, now, still seems it might suggest they are a bit stumped... having a hard time countering the CLYW inputs... and they quite clearly are not wanting the judge to rule, based on the CLYW inputs, before they at least get another chance to try to make some other input.

That they don't feel comfortable having it go to the judge right now... and need time to think about it... is probably meaningful.

Still, the only result delivered thus far is in the delay that was granted to let the T-mobile lawyers think about it a bit more before filing what ever else it is they can think up next, whatever it is they think might help them by quibbling about it, still, given the obvious impact of the most recent CLYW filings...

We'll see what they come up with... then see what else CLYW has to add in response, if anything, after that... and THEN maybe the judge rules.

Their dismissal request still looks pretty tenuous, it is pretty clearly a long shot, at best... and it still seems that it is about the only thing they've got left to hide behind...
