The judge has granted standing for one of the groups involved in the bk to file suit to recover 5-HMF on behalf of XI.This was a very important ruling. The issue will be litigated and I think there is a very strong case to reverse the sale.
As far as the cr. cmte. He who has the lic for Nicosan is the 800# gorilla in the room. If Monty gets control, imo they would have no choice - in their own interests, to negotiate w/ us. What would be their alternative ? XI is an empty egg carton right now. The cr. cmte would have nothing to market but they would have 20MM of debt.
Ideally, getting the lic. and recovering 5-HMF would put XI in the best strategic position it has ever been in, imo. Monty would establish a global sales team andit would be off to the races.
Under this scenario, seeing RSnot and SB donning orange jumpsuits in adjoining cells, each w/ their own large hairy bunk mate would be icing on the cake.........
