For starters nowhere does it say they withdrew the funds to for the 78,000 dollar check. It also seems when you sign a contract with someone, and are still negotiating certain parts it doesn't make good sense to give the other party the check to hold. In many states a verbal agreement is a binding contract provided you can prove such statements were made. It's not a good busisness practice for any company officer to act in such a careless with company funds.
Hardly! the court will decide and they could still enter a summary judgment on March 2nd. it'll be interesting to see what counter argument & claims MSG comes up with. I have an idea what those will be, but, we'll see.
All it proves is that Moskowitz is willing to say anything in an affidavit to the court. He has been caught fudging to the courts before. Do some DD on his tax case.
And by the way, what is it with the ticket scalping nonsense? I suspect that the lawyers for the class action lawsuits will find his affidavit a very productive area to which they can now direct some attention. What happened to all of the tickets he was acquiring from the various sporting venues and more importantly, where did they money go once they were scalped?
"America's Ticket Company" (supposedly now part of VAEV) is an operation run by one of Mosko's buddies.
This was printed before Mosko announced his new ticket company at VAEV. Note the name on the FirstHand Tickets business card of Warren Schrieber is the "President" of VAEV's new "ticket company"
Also notice that in Mosko's affidavit, he tries to claim the purpose of the checks was to pay SPNG money for blocks of premium tickets to MSG events.
I suspect this just adds to the list of self dealing efforts Mosko was involved in. Perhaps Mosko had an agreement with Schrieber to scalp those SPNG acquired tickets in exchange for some cash on the side. It makes good sense for Mosko and no sense at all for SPNG.
Two and a half years ago, the State of New York legalized scalping and made it legal to charge as much as possible for the second hand tickets.
SPNG has no ticket business but VAEV and Schrieber do. No ticket sales revenues have ever been shown on SPNG financials. Where were all of the premium tickets going? SPNG has been picking up tickets for a long time in association with their advertising purchases.
