FDA were expected to appeal, hardly a surprise right? They are power drunk and cannot (more like will not)grasp this is NOT a cessation device. They have no right to attempt regulation IMO. Anyone may file an appeal, they lost once, they can lose again. These things are already selling in the USA anyway.
