I posted this last week based on fact. Please feel free to run it by any lawyer. You don't have the right to defame EXPO because JD's numbers were off and he didn't correct them. JD put out numbers that were projections. JD has even revised 2010 projections based on the latest information he's received from current as well as future clients. Now that's a fact. Again these numbers may be off again but to use this as an excuse to defame the company is nonsense and against the law.
The laws as it relates to pink sheet companies is no different from the law that relates to NYSE, NASDAQ, AMEX, etc. You can criticize them but telling falsehoods that are not based upon fact or that are intentionally untruthful are defamatory and subject to legal action.
A company does not lose it's legal right simple because it's on pinksheets. In fact, the law protects private companies that are not listed on any exchanges from defamation the same as it protects companies listed on any exchange. The same applies to the defamation of a person. He or she is protected from defamation the same as a NYSE company.
The fact that pink sheet companies frequently engages in fraud and misrepresent the fact does not mean that pink sheet companies can be defamed.
