yes, you have to take the risk of losing what you put in penny market.
Besides the failure of merger, another thing I am concerning is that the company MIGHT do Reverse Split to get enough shares (75%) for giving the merger partner (just like what INCL did).

I have a couple times what you are holding. So I HOPE the merger done without any RS.
