I've been buying using Scottrade after the ce was applied. BEHL is not on their restricted list.

Be sure to take Scott a bank check, money orders or a bank transfers become restricted funds for 3 days and you cannot use those funds to by BEHL. Been there done that, not because of CE status but because it is a penny stock.
