Assuming the 10K was completed, certified and signed:
Could the SEC require the company to delay the formal filing subject to their review? Would you expect the SEC to provide feedback to the company prior to filing? Could they impose changes prior to issuance, even after certification by Robison?


this is my opinion .. after speaking to a number of sec investigators ...

1) Could the SEC require the company to delay the formal filing subject to their review?

no, the SEC said .. the company is required to file and if question came up the SEC would inquire ( or take action if considered misleading or false )

2) Would you expect the SEC to provide feedback to the company prior to filing?

if there were questions about the rules the SEC could answer of refer the company/auditors for the correct updated publication
but as far as helping them complete the filing as far as what to say in the filing .. NO

3)Could they impose changes prior to issuance, even after certification by Robison?

back to question #1 - if there are question the SEC will make inquires ( or act ) - such as they did in the 2008 filings
- or suspend or wells notice ..

just my O from past conversations with the SEC ... I guess if you asked 3 investigators you could get 3 different answers or opinions of the rules
