So what if they are up for sale - but not "in the money"?

Can a broker still use them to short?

I'm using TDAmeritrade.

If ScottTrade will not short a stock under 2.50/share, how can you short LLEG? Most B/D's have similiar requirements. So, I am still trying to figure out how to squeeze the shorts on LLEG, anyone? Not sure what I am missing, Thanks
