speaking of litigation, do you have any idea how many institutional investors own these preferred shares? what about all the states and municipalities that were sold on them by lehman before the fall? serveral cases are already in the works to retrieve $$ on them, lodged by various governments, but if some judge said "sorry folks, you're all screwed" that would open a floodgate of outrage, and even more lawsuits, the likes of which we've never seen. jmho.
