The decision is made by the DOJ. Attempts have been made to get an official equity committee, but none to date has been approved. The denial is at this time only, leaving the door open in the near future. The DOJ has recently began calling the committee ad hoc which is a positive sign.
The ad hoc group consists of the heavy weight shareholders and it's my opinion there will be an official equity committee formed. Push has not yet come to shove and this group is powerful.
