i will clarify to say that within the scope of an investigation that the sec may incline a company to make certain statements about affiliate relationships, but that would not be inclusive to mandating an announcement of the investigation itself...

the decision to make an announcement of an SEC investigation is made soley by the company and its council.

I wonder how many people on the Titanic spent their last few hours arguing how the Titanic was built to not sink and why the fact that water was filling the hold was not actually a design flaw.

Some people may choose to hang on to the idea that SPNG didn't have to disclose the investigation but that will do nothing to change the course of events which are to follow. The investigation is underway and it is directed at the company and the promoters and anyone involved in appurtenant violations of Securities law.
