The court ruled in April that the Exchange funds were not held in trust and therefore were part of the general assets...not sure where they appear on the MOR as it is not consolidated...

It's the risk/reward associated with buying any security let alone a company in chapter 11. The odds in this case relative to many other Q companies are much more in our favor in my opinion.

Its GREAT to see meaningful discussion and review of the facts on this board.

One question raised was the total amount of the 1031 exchanges. That amount is in the 400-450 million range depending on if you speaking of total or just the comingled accounts. In either event I think we can assume that while the judge did make those funds part of the estate, the 1031 exchangers will have the same priority to any remaining funds as other creditors so they will be ahead of the commons.

I'm hoping for a few cents to a few dollars. Please note that I wouldn't refuse a higher amount, just trying to be realistic given the outstanding claims. :-)
