If they sued the wrong Defendant then that's a problem - Canada is not per se the wrong country if they can establish a basis for jurisdiction there (not that hard). They seem to have been given permission to re-file an amended complaint (which would not happen if there was no jurisdiction) so there may be some enforceable merit to the claim.

My point was that it is patently ridiculous for anyone to state that Canadian law cannot be enforced in the US under these circumstances. I get very frustrated with these posters who make grandiose claims regarding issues they obviously know nothing about. Is this a forum for thoughtful / helpful discussion about a stock all posters have a common interest in or is it a vehicle for uninformed comments on issues posters seem to know nothing about, but hope that stating an opinion with enough certainty will make them appear knowledgeable?
