Thanks justavoice - that helps, but like microphoneman I'm not clear on whether a judge is allowed to look at NOLs/non-GAAP stuff when making the call on what to do with commons.

As a stock I'm not worried at all :-)...and come to think of it I would hope a reasonable judge could take the marked investor interest in common shares as an indication that the market sees value there book value aside.
