sounds like a good defense to me. why didn't eeso respond to the lawsuit instead of ignoring it and receiving a default judgement againt them? if umark screwed up, eeso shouldn't pay the bill. why did they not fight the lawsuit? my guess is you are getting lies from eeso.

It would have cost more for travel and legal expenses than what it was worth, all to pay for someone elses mistake.
